L. Durain et al. to Jacob Diebold -- Know all men by these presents:

That Louis Durain and Barbary Durain, his wife, John Scheer and Magadine*) Scheer, his wife, of the County of Warren, Ohio, in consideration of One Thousand and forty Dollars ($1040.00) to them paid by Jacob Diebold of said County of Warren, Ohio, the receipt whereof is hereby acknowledged, do hereby Grants [sic] Bargain Sell and Convey to the said Jacob Diebold his heirs and assigns forever the following Real Estate situate in the County of Warren and State of Ohio discribed as folows [all sic] to wit : Being part of Military Survey No. 3795, to wit: Beginning at a Stone corner to Lindsay Mounts and Jacob Diebold and in a County Road running thence with said County Road S43-1/2°W **) 38.2 poles to a stake Thence N39-3/4°W one hundred poles to a Stake in Littles run [sic] where a stone bears S39-3/4°E 50 links Thence down Littles run [sic] as it meanders N35-1/4°E 32 poles to a Stake thence N68-1/2°E 5.2 poles to a stake Thence N2-1/2°E 14.4 poles to a Stake Thence N17°W 8 poles to a stake Thence N32-1/2°E 10.7 poles to a stake in Jacob Diebold’s line Thence with his line S43°E 116 poles to the beginning containing Twenty four Acres 1 Rod and twenty one poles and all the Estate, Title and Interest of said Louis Durain and John Scheer Barbary Durain and Magdelen Scheer either in Law or in Equity of in and to the said premises: Together with all the privileges and appurtinances [sic] to the same belonging and all the rents issues and profits thereof; To Have and To Hold the same to the only proper use of the said Jacob Diebold his heirs and assigns forever And the said Louis Durain and John Scheer for themselves and for their heirs executors and administrators do hereby Covenant with the said Jacob Diebold his heirs and assigns that they are the true and lawful owners of the said premises and have full power to convey the same; and that the title so conveyed is Clear Free and unincumbered [sic], and further that they will Warrant and Defend the same against all claim or claims of all persons whomsoever In Witness Whereof the said Lewis [sic] Durain and Barbary his wife, John Scheer and Magdaline Scheer his wife who doth hereby release their right and expectation of Dower in the said premises have hereunto set their hands and Seals this 23d day of April in the Year of Our Lord on thousand Eight hundred and Sixty four. (Signed and Sealed): Lewis Durain, Barba [sic] Durain, John Scheer, Magdalena Scheer (N.B., DNR: her signature in the old German script). Acknowledged in the presence of: J.D. Wallace and John Feitzer. Received for Record April 26 1864 and Recorded May (?; maybe the 4th) 1864. P.F. Sullivan RWC(?)

State of Ohio, County of Warren, (SS): Be it Remembered that on the 23d day of April in the Year of Our Lord One thousand Eight Hundred and Sixty four before me a Notary Public in and for said County of Warren personally came Louis Durain and Barbary his wife John Scheer and Magdalene his wife the grantors in the foregoing Deed and acknowledged the Signing and Sealing thereof to be their voluntary act and deed for the uses and purposes therein mentioned and the said Barbary Durain and Magdalene Scheer wifes of the said Louis Durain & John Scheer being examined by me separqate and apart from their said husbands and the contents of said Deed being by me made known and explained to them as the statute directs declared that they did voluntarily sign seal and acknowledge the same and that they are still satisfied therewith as their act and dee4d for the uses and purposes therein mentioned. In Testimony Whereof I have hereunto Subscribed my name and affixed my Notarial Seal on the day and Year aforesaid. J.D. Wallace Notary Public Warren County Ohio.
