This Indenture made this Eighth day of October in the year of our Lord one thousand Eight hundred and thirty Eight Between Jacob Ertel and Malinda Ertel of the first part, and Theophilus Simonton, Jun., all of the County of Warren in the State of Ohio of the second part, Witnesseth that the said Jacob Ertel and Malinda Ertel ?foresad? in consideration of the sum of Eight hundred dollars Lawful Money of the United States to them in hand well and truly paid by the said Theophilus Simonton Jnr. the Receipt whereof is hereby acknowledged have granted bargained Sold aliened released conveyed and confirmed and by These presents do grant, bargain, Sell, alien, release, convey and confirm unto the Said Theophilus Simonton Jnr. his heirs and assigns forever, All the following described lot or parcel of land part of Military Survey Number (the number is blank, not written in: DNR) made in the name of James McElhaney, between the Little Miami and Sciota [sic] Rivers in Hamilton Township, Warren county, and being the same lands by Daniel Ertel deceased to his son Jacob. Off the north end of the tract willed to John Ertel & said Jacob. Beginning at the North East corner a Stone to John Ertels lot of one hundred acres, thence with Johns line N.84°52’W with his line 28.90 chains to a Stone N. West corner to Said John in Joel Greeleys line thence N.4°04E. with Greeleys East line 26.04 chains to the N.W. corner in A & W Liggits line then S. 82-3/4° E. 29.72 chains with Said Liggits and Daniel Ertels line to a Stake for the N.E. corner & corner to N. ?Cosons Lands? (query by DNR) thence S. 5° 16’W. with said Cason line 24.99 chains to the beginning containing seventy five acres one Rood and 1 pole of land be the same more or less. And all the estate, right, title, interest, claim and demand of them the Said Jacob Ertel and Malinda Ertel of, in, and to the Said premises, and every part thereof: Together with all and Singular the privileges and appurtenances to the same belonging, as in anywise appertaining: and the rents, issues, and profits thereof: To have and hold the premises hereby bargained and sold as meant or intended so to be, with the appurtenances , to the only proper use and behoof of the Said Theophilus Simonton Jnr. his heirs and assigns forever. And the Said Jacob Ertel and Malinda Ertel for themselves, heirs executors and administrators, do promise covenant and agree to and with the Said Theophilus Simonton Jnr. his heirs, executors, and assigns, that they are the true and lawful owners of the premises hereby granted and have good right, full power, and lawful authority to sell and convey the Same, in manner and form aforesaid: And Further; that they the Said Jacob Ertel and Malinda Ertel, their heirs, executors, and administrators will warrant and forever defend the aforesaid premises, with their appurtenances and every part or parcel thereof unto the Said Theophilus Simonton Jnr. his heirs and assigns, against all persons claiming or to claim by from or under them, or any of them; or by, from , or under any other person or persons whomsoever.

In Witness Whereof. the Said Jacob Ertel together with Malinda Ertel his wife, who hereby relinquishes her right of dower in the premises, have hereunto Set their hands and Seals the day and year first above written. Signed and sealed by Jacob and Malinda Ertel.

Sealed and delivered in the presence of John Hopkins, John Ertel.

The State of Ohio, Warren County SS: Before me John Hopkins a Justice of the Peace within and for the said County personally appeared Jacob Ertel together with Malinda Ertel his wife, the within named grantors and acknowledged the above deed of conveyance to be their voluntary act and deed, for the uses and purposes therein mentioned. And the Said Malinda, wife of the Said Jacob Ertel being examined Separate and apart from her Said husband, and the contents of Said deed being made known and explained to her declares that she voluntarily and of her own free will and accords without any fear or coercion of her husband, did and now doth acknowledge the Signing and Sealing thereof & that she is till satisfied therewith. In Testimony Whereof I have hereunto set my hand and Seal, this eighth day of October 1838. In the year of our Lord one thousand Eight hundred and (left blank: DNR).
