THOMAS/MARTHA PAXTON TO ADAM SIMONTON

This Indenture made the fifth day of August in the Year of our Lord one thousand eighteen hundred by and between Thomas Paxton and Martha Paxton his wife of Clermont county and Territory N.W. of the Ohio River of the one part and Adam Simonton of Said County and Territory of the other part. Witnesseth that the said Thomas Paxton and Martha his wife for and in consideration of the sum of one hundred and fifty pounds specie, Pennsylvania Currency to them in hand well and truly paid by the said Adam Simonton before the ensealing and delivery of these presents the receipt and payment of which the Said Thomas Paxton, and Martha Paxton his wife, doth hereby acknowledge and thereof and Therefrom doth acquit release exonerate and forever discharge the Said Adam Simonton his heirs executors and administrators by these presents, hath and doth hereby grant bargain Sell, alien, enfeoff, convey & confirm unto the Said Adam Simonton his heirs and assigns forever all that that [sic] tract or parcel of land, lying and being in Clermont County & Territory aforesaid, viz: Beginning at a certain beech tree & two oak grubs on the South bank of O Bannons Creek and on a line of Joseph Carrington’s Survey, thence along Carringtons line S.60°E. 144 poles to two hickorys and white walnut corner to Carrington, Thence east 396 poles to Two Sugar trees and a white oak, Thence N. 60° W. 245 poles to a white oak, ash and dogwood. Thence S. 70° W. 102 poles to a Sugar tree and locust, on the Said South bank of O Bannon, Thence down O Bannons Creek by its diferent [sic] meanders to the place of Beginning. Containing 300 acres. To have and to Hold the Said premises, with all and singular the appurtenances thereunto belonging or in anywise appertaining to the only proper use benefit and behoof of the Said Adam Simonton & his heirs & assigns forever. And the Said Thomas Paxton and Martha Paxton his wife for themselves their heirs executors (N.B. by DNR: inserted later here, between the lines, is, "covenant & grant unto the said Adam Simonton his heirs executors administrators") administrators and assigns, that they the Said Thomas Paxton and Martha his wife are by pattent [sic] lawfully and rightfully seized of the beforementioned premises and of every part and parcel thereof and also that they the said Thomas Paxton and Martha Paxton, with good right, full power and lawful Authority in their own right to grant bargain, sell and convey the Same in manner and form aforesaid

And the Said Thomas Paxton and Martha Paxton for themselves their heirs executors & administrators further covenant and grant unto the Said Adam Simonton his heirs executors administrators and assigns, that the before mentioned premises, with all and singular the appurtenances thereunto belonging or in any wise appertaining unto the Said Adam Simonton and his heirs and assigns, against the Said Thomas Paxton and Martha Paxton his wife and their heirs & administrators and every other person or persons whatsoever shall and will warrant and by these presents forever defend. In Witness Whereof the said Thomas Paxton and Martha Paxton have hereunto set their hands & seals at their own dwelling house the day and year above written.

Signed Sealed and acknowledged in the presence of John Donnel, Alexander Hall.

N.B. It was acknowledged before the Signing and delivery these presents that the words "containing 300 acres" begins the eighteenth line, also that "Clermont" is the fourth word in the third line.

State of Ohio, Clermont county SS// Before me Silas Hutchinson one of the Justices of the Peace in Said County personally appeared Martha Paxton widow of the within named Thomas Paxton decd., who voluntarily signed her name and relinquished all her right title interest claim and demand of the within described tract of land. In Testimony whereof I have hereunto set my hand and affixed my Seal this 8th day of April 1820 (*). Silas Hutchinson (signed/seal) Justice of the Peace

April 20th (*) 1801 Personally came before me a Justice of the Peace of Clermont county, Thomas Paxton and acknowledged the within deed according to law. (*) Philip Gatch (*)
