This Indenture made this twenty second day of October in the year of our Lord eighteen hundred and thirty six between James Chesser and Sarah Chesser his wife of the County of Shelby and State of Indiana of the one part and Moses Ross of the County of Warren and State of Ohio of the other part Witnesseth that the said James Chesser for and in consideration of the sum of one hundred and fifty two dollars current money to him in hand paid the receipt whereof he doth hereby acknowledge and forever acquit and discharge the said Moses Ross his heirs executors and administrators and doth by these presents grant bargain sell alien and confirm unto the said Moses Ross his heirs and assigns forever all that tract or parcel of land lying and being in the County of Warren and State of Ohio on Taylors fork of Todds fork containing twenty five and one third acres be the same more or less being part of Survey No. 1499 and bounded as follows, to wit, beginning at an elm stump about twenty feet high on the south side of said creek standing on the bank in Joseph Lees line, thence S37°E fifty six poles to three dogwoods corner to John Spurlins (?lot?) thence North 53°E with the line of said (?lot?) seventy two poles to a stake corner to George Constable, thence N37:°W [sic] to a stake another of George Constables corners fifty six poles thence ?S?55°W seventy two poles to the place of beginning. Together with all and singular the appurtenances to the said premises belonging or in any wise appertaining and the reversions remainders and profits thereof and all the estate right title interest property claim and demand of him the said James Chesser of in and to the same. To have and to hold the lands hereby conveyed with all and singular the premises and every part and parcel thereof with every of the appurtenances unto the said Moses Ross his heirs and assigns forever to the only proper use and behoof of him the said Moses Ross his heirs and assigns forever. And the said James Chesser and his heirs all and singular the premises hereby bargained and sold unto the said Moses Ross his heirs and assigns against him the said James Chesser and his heirs and all and every other person or persons whatsoever, doth and will Warrant and forever Defend by these presents, and Sarah Chesser wife of the said James Chesser doth hereby relinquish all her right and title of dower in the premises aforesaid. In Witness whereof they the said James Chesser and Sarah his wife hath hereunto set their hands and seals the day and year first above written. (James and Sarah Chesser signed by marks) (seals). State of Indiana Shelby County Court: Be it remembered that the within named James Chesser and Sarah his wife came this day personally before me the undersigned a Justice of the Peace in and for the county of Shelby aforesaid and acknowledged that they signed sealed and delivered the within indenture as their act and deed for the purposes therein specified. And the said Sarah being of full age and being by me examined separate and apart from her said husband and the contents of the said indenture being made known to her declared that she relinquished all her right and title of dower in & to the lands and ?tessements? in the within indenture set forth and described and that she voluntarily and of her own free will and accord and with [sic] any coercion or compulsion of her said husband signed sealed and delivered the said indenture as her act and deed for the purposes aforesaid under my hand and seal at James Chesser in the county of Shelby aforesaid this twenty second day of October A.D. 1836 J.B. State of Indiana Shelby County: I Sylvan B. Morris Clerk of the Shelby Circuit Court certify that Joshua B. Lucas Esquire before and by whom the above acknowledgment appears to have been made and taken was at the date thereof an acting Justice of the Peace of said county duly commissioned and qualified and that full faith and credit is due all his official acts as such, and that the signature thereto purporting to be his is genuine.
