To all to whom these presents shall come, Greeting. Whereas on the tenth of April AD 1854 John Donnel feted his certain Petition in the Court of Common Pleas of Clermont County against Ellen Donnel and others demanding partition of certain real Estate hereinafter described, and whereas such proceedings were had upon said petition that the commissioners appointed by said court to make partition of said Real Estate make report that the same canot [sic] be divd. without manifest injury to the same and that the value thereof is twenty-five dollars per acre afterwards to wit at the October term AD 1854 of said court said report of the Commissioners was approved and confirmed and . . an order of sale issued to George W Richards Sheriff of said County after advertising the same for more than ?thirty? days in a newspaper called the Clermont Sun a paper of general circulation in said county and on the 17th day of March AD 1855 I exposed to public auction at the door of the courthouse in Batavia in said county (?& struck of?) to the same to Theophilus Donnel for the sum of twenty five dollars per acre making Eighteen hundred and twenty five dollars he being the highest and best bidder for the same and it being more than two third the appraised value thereof, afterwards to wit at the March term of said court AD 1855 the proceeding and sale made as aforesaid by said Sheriff was appointed and confirmed and the said court ordered said Sheriff of Clermont County to execute and deliver a deed in fee simple for the real Estate so sold as aforesaid all of which will more fully appear reference being had to the records of said court Now therefore I George w Richards Sheriff of Clermont County Ohio by virtue of the powers in and vested by law do by these presents grant bargain alien and convey unto the said Theophilus Donnel his heirs and assigns forever the following premises beginning at the Locust on the bank of Obanion Creek thence East one hundred and Thirty seven poles (say 137 poles) to a Chickory and beech thence north 25 (degrees) west Ninety four poles (say 94 poles) to Chickory sugar & Elm trees thence South 81-1/2 West one hundred and six poles (say 106) poles [sic] to a mulberry & Elm on the bank of the creek thence up the creek by the diferent [sic] cources [sic] or

manders [sic] thereof to the place of beginning containing Seventy three acres and Seventy six poles more or less with all and singular the appurtenances to him the said Theophilus ?Donnel? his heirs and assigns forever I Testimony whereof [sic] I George W Richards as Sheriff as aforesaid have hereunto set my hand and seal this Twenty first day of March AD 1855 (signed:) George W.
