This Indenture made the Sixteenth day of October in the year of our
Lord One Thousand eight hundred and thirty Seven between Jane Curtis and Mercy
Nicholson of the County of Warren and State of Ohio Jane McConn and
John Curtis of the County of Dark and State of Ohio and Joseph Curtis of the County
of Wayne and State of Indiana of the first part and James Kirby of the County of
Warren and State of Ohio of the Second part. Witnesseth that the said party of the
first part for and in consideration of the Sum of Four hundred and Sixty one dollars
and twenty five cents lawful money of the United States to them in hand well
and truly paid by the said party of the Second part, the Receipt whereof is hereby ac-
knowledged, hath granted, bargained, Sold, conveyed and confirmed and by These pres-
ents doth grant, bargain, sell,convey and confirm unto said party of the Second part
his heirs and assigns forever, all and Singular the following described Lot tract or
parcel of land towit: Lying and being in the County of Warren and State of Ohio be-
ing a part of Section thirty four in Township four Range four between the Miami rivers
Beginning at a Stone at the South East to James Carters on the line of [WaiSonbegar?]
thence with said line No. 2º W. 38 75/100 poles to a Stone thence No. 80 3/4 W forty poles
to a Stone by Joseph Kirbys orchard fence thence with said fence South 5º 55' W.
thirty eight & 2/10 poles to a Stone on Daniel Crane's line thence with said line South 80º 3/4
E R 4 poles to the place of Beginning containing Ten acres be the Same more or less.
Together with all and Singular the hereditaments and appurtenances thereunto be-
longing or in anywise appertaining, and the rents issues and profits thereof and
all the Estate, right, title, interest claim or demand, whatsoever, of the said party of the
first part either in law or equity, of, in, and to, the above bargained premises, to the
Said hereditaments and appurtenances To have and to hold the said premises, above,
particularly mentioned and described, to the said party of the Second part his heirs
and assigns forever. And the said party of the first part do for themselves their heirs ex-
ecutors and administrators covenant and grant to and with the said party of the se-
cond part his heirs and assigns, that they the said party of the first part lawfully
seized in fee of the aforesaid granted premises, that they are free from all incumbrances,
that they have good right to Sell and convey the Same to the said party of the Second
part aforesaid; and that they will, and their heirs, executors, and administrators
Shall Warrant and defend the same to the Said party of the Second part, his heirs
or assigns forever, against all lawful demands of all persons. In Witness where-

On this Seventh day of October in the Year of our Lord one Thousand Eight hundred
and thirty Seven the grantors named in the above deed of conveyance persoanlly appeared
before me, one of the Justices of the peace, in and for said County, and acknowledged
the above Indenture to be their Voluntary act and deed. Given under my hand
and Seal the day and year above written.
