Heirs of Levi Brown to A. B. Howell - 12 Jun 1855 (Lease)

This agreement made and entered into this twelfth day of June A. D. 1855 between Phebe Brown
widow of Levi Brown, late of Warren County Ohio, decd. and B. T. Brown, Norman Brown, Ruth Brown,
Eli T. Leaming and Eliza Leaming (late Brown) his wife of Warren County Ohio and Joshua Stephenson
and Ellen Stephenson (late Brown) his wife of Butler Co. O., and Joel Hawley and Sarah Hawley (late Brown)
his wife of Clermont Co. O., and William McCormick and Lucinda McCormick (late Brown) his wife
of the city of Covington Kentucky, heirs and legal representatives of said Levi Brown dec’d. of the first part,
and Alfred B. Howell of Warren County Ohio, of the second part, Witneseth that the said parties of the first
part for and in consideration of the covenants herenafter mentioned, do hereby demise, lease, grant and to farm-
let to the said part of the second part, his heirs and assigns for the term of ten years from and after the 1st day
of March A.D. 1854 the following described real estate, to wit; Part of a tract of about forty one acres of land
situate in Section No. 16 Township No. 5 Range No. 3 M.R.S. in Warren Co. O. which the said Levi Brown
dec’d. held and possessed at the time of his death, by virtue of a perpetual lease from the Trustees of said town-
ship; the part herby intended to be leased being in two tracts or parcels and is thus described, to wit:
1st Tract: Lying on the North side of the Chillicothe road, Beginning on the North side of said road in
the West line of the whole tract, thence Eastwardly with said road to Lewis Perrine’s West line, thence with
said line North about 50 rods to a point about 60 feet North of a Black Walnut tree, thence West Parallel
with the first line to the West line of the whole tract, thence with the same to the beginning: Excepting the part
of said tract on which the Blacksmith shop now stands. 2nd Tract: - Lying on the South side of said road,
Beginning in the East boundary line of the whole tract, ten feet south of the line of the orchard now on the tract,
thence with said East boundary line South to the South East corner of the tract, thence with the South boundary line
of the tract to the South West corner thereof, thence with the west boundary line thereof to a stone (planted) nearly
opposite to the beginning point, thence to the beginning. And the said party of the second part hereby covenants
and agrees to pay as rent for the premises hereby demised the sum of Three Dollars per acre, at the end of each
and every year during said term - (also the said Howell is to keep up the fences at his own expense) which
sum it is hereby agreed shall be paid to Ruth Brown, one of the parties of the first part. And the said parties
of the first part further covenant and agree to keep the said part of the second part his heirs and assigns in pea-
cable possession of the real estate above demised for the term aforesaid: to pay all taxes, charges, rents to said
Township &c. accruing thereon (except taxes accruing on improvements made thereon by the party of the second
part) and in case the said parties of the first part shall fail to keep said property free from said taxes, charges, etc;
it is hereby agreed that said part of the second part may to prevent forfeiture or sale of said premises for taxes, pay
any of said taxes, charges, &c. on the whole tract out of the rent above agreed to be paid. In Testimony whereof,
the parties of the first and second parts have hereunto subscribed their names and affixed their seals.

Warren County ss: Personally came before me the subscriber, a Justice
of the Peace within and for the county aforesaid, Phebe Brown, B.T. Brown, Norman Brown, and Ruth
Brown and Lucinda McCormick, and acknowledged the foregoing instrument of writing to be their volun
tary act and deed for the uses and purposes therein mentioned. Given under my hand and seal this twelfth
day of June A.D. 1855. J. D. Blackburn J. P. {seal}

The State of Ohio, Warren County ss: Personally came before me the subscriber a Justice of the Peace
within and for said county, Eli T. Leaming and Eliza Leaming his wife, and acknowledged the signing
and sealing of the foregoing instrument of writing to be their voluntary act and deed for the uses and purpo
ses therein mentioned. And the said Eliza Leaming on being examined by me separate and apart from her said
husband declared that she did freely and voluntarily sign said instrument of writing without fear or coercion
from her said husband and that she is still satisfied therewith. Given under my hand and seal this 12th
day of June A.D. 1855. J.D. Blackburn J.P. [seal]

The State of Ohio, Butler County ss: Personally came before me the subscriber, a Justice of the Peace within
and for the county and State aforesaid Ellen Stephenson and acknowledged the signing and sealing of the
foregoing instrument of writing to be her voluntary act and deed for the uses and purposes therein mentioned.
And the said Ellen Stephenson wife of the said Joshua Stephenson on being examined by me at the same
time and place separate and apart from her said husband and the contents of said instrument of
writing being made know to her by me declared that she did freely and voluntarily sign the same without
fear or coercion from her said husband and that she is still satisfied therewith. Given under my hand
and seal this 12th day of June A.D. 1855 James Middleton J.P. [seal]

State of Ohio, Clermont County ss: Be it remembered that on the twenty eighth day of December 1855
before me the subscriber, Notary in and for said county, personally came Sarah Halley wife of
Joel Halley deceased, who acknowledged the signing and sealing of the writing or foregoing instrument of
writing as her voluntary act and deed for the uses and purposes therein mentioned and that she is still
satisfied therewith. In testimony whereof I have herewith subscribed my name and affixed my Nota-
rial seal on the day and year last aforesaid.
