Summary:

Simon Gillespie left 50 cents to each of his married children (or their heirs) with the remainder of his estate left to his wife, Hannah, and 2 unmarried daughters, Ebalinah and Tizby. The following was noted in a review of the contents of Will Packet #36

  • The inventory of personal property was valued at $225. 72
  • Real estate consisted of a house on east 1/2 of town lot 19 in Mason, Ohio. Ebalinah and Tizby deeded the property to their mother for $500.
  • Included in a list of debtors was Harvester Gillespie with a note dated 1 May 1848 for $54.00 and a 2nd undated note for $18.80
  • There were only 3 vouchers for the disbursement of 50 cents
    • Junius Gillespie on 12 Feb 1850 [believed to be the son of Simon Gillespie]
    • James A. Johnson [thought to be either the husband [or son] of Simon Gillespie's daughter, Thurissa Gillespie who married James Anthony Johnson on 6 March 1834 in Warren County, Ohio]
    • Angeline Kirk [thought to be the daughter of Simon Gillespie's daughter, Zindora Gillespie who married Jonathan Kirk on 23 Apr 1829 in Warren County, Ohio]
  • The estate was settled on 3 May 1852 with a total value of $2,908.59. The will packet contained numerous vouchers for disbursements to Hannah, Ebalinah and Tizby Gillespie while the estate was being probated. [The spelling of the daughter's names is as they signed it on numerous vouchers in the will packet. Hannah was evidently illiterate as she made "her mark" on the vouchers.]

Simon Gillespie Will dated 27 Nov 1847 [on file in Will Box 36]

In the name of the benevolent father of all

I, Simon Gillespie of the County of Warren and State of Ohio being weak in body but strong in mind and memory in order that my family may live in peace after my death do cause? this my last Will and Testament to be written

and first

I want all my lands houses and town lots all my deeds mortgages and all other paper that are of any value Notes _____ and accounts due? shall belong to my wife Hannah and to my two daughters Ebalina and Tisby.

As for those that have married and left me I provided I have provided for them as much as I considered I was able What I thought just and equitable but I here __ to each of those that have married the sum of fifty cents.

and for those that are dead I want there children to receive the fifty cents that was intended for their parents.

And I hereby constitute and appoint Bainbridge Miller executer to this my Last Will and Testament to do and perform all the requests agreeable to the Laws of the State of Ohio.
